In his divorce petition, the 44-year-old actor requested that their prenuptial agreement be honored and that their assets and debts be divided equally. Additionally, Foster asked that both parties cover their own legal fees, with court expenses to be shared. Foster and Prepon, both aged 44, first became publicly linked in 2016. Their relationship quickly blossomed, leading to an engagement within months. In 2017, they welcomed their first child, a daughter named Ella. The couple tied the knot in 2018, with Prepon sharing a heartfelt message on Instagram to commemorate their wedding day.

In 2020, the couple expanded their family with the birth of a son, though they opted to keep his name private to protect their children from public attention. Prepon explained their decision in an interview with People magazine, emphasizing their commitment to privacy regarding their children. The couple was meticulous about balancing their public lives with their private family time, ensuring that their home life remained harmonious despite their busy careers.

Prepon shared in a 2019 interview that she and Foster were adept at managing their schedules to support each other's careers while maintaining a strong family life. She also admitted to feeling guilty at times, acknowledging the challenges of balancing a career and family responsibilities.
