With Trump now gearing up to reenter the White House, Bragg has the option to either delay the sentencing scheduled for November 26 or even dismiss the case entirely. The prosecutor may seek to postpone Trump's sentencing date, which stems from his conviction for concealing a payoff intended to hide a sex scandal from voters prior to the 2016 presidential election. Alternatively, Bragg could push for the case to be dismissed outright. Any such move would require the approval of Manhattan Supreme Court Justice Juan Merchan before it can be implemented.

Should either scenario come to pass, it would mean that Trump, at 78, would retake the presidency largely unscathed, despite the four criminal cases that once posed a significant threat to his candidacy. Additionally, Judge Merchan is expected to rule on Tuesday whether to nullify May's verdict in light of the US Supreme Court's July ruling that grants immunity to a president for 'official acts' carried out while in office. Trump's attorneys have contended that the trial was irreparably 'tainted' by evidence presented from Trump's first term in the White House. However, prosecutors argue that the high court's ruling has 'no basis' in the Manhattan case.
