A New York judge is set to make a decision on Tuesday regarding the potential dismissal of Donald Trump's conviction in the criminal hush money case, following the Supreme Court's ruling on presidential immunity earlier this year.
The President-elect, who faces up to four years in prison, was found guilty on all 34 counts of falsifying business records to conceal payments to porn star Stormy Daniels prior to the 2016 election. In a 6-3 decision in July, the US Supreme Court ruled that former president Trump has absolute immunity from prosecution for 'official acts' during his presidency. The court deferred to lower courts to determine what qualifies as an 'official act' by a sitting president.
Manhattan Supreme Court Justice Juan Merchan postponed sentencing for over four months, ensuring it would occur after the election. If the conviction stands, Trump is scheduled to be sentenced on November 26, just a few weeks before his inauguration.
