Starbucks has faced a third lawsuit from a company alleging that the coffee giant stole its idea for coffee-flavored lipstick and lip gloss. Balmuccino, which has had a sister-in-law of TV doctor Mehmet Oz among its leaders, filed the complaint on Friday in Manhattan federal court. This comes after a Seattle federal judge dismissed a previous version of the lawsuit in July 2023 on procedural grounds, marking the second dismissal of such claims. Starbucks, headquartered in Seattle, has not provided any immediate comments. Balmuccino claims it started developing coffee-flavored lip balms in 2016 and presented them during a meeting at Starbucks' New York office in October 2018, where prototypes and confidential information were shared. The Los Angeles-based company states that Dr. Oz facilitated the meeting, contacting Starbucks CEO Howard Schultz to propose a potential joint venture. Balmuccino accuses Starbucks of stealing its lip balm concept by introducing the 'S'mores Frappuccino Sip Kit' in April 2019, which included lipstick and gloss in four shades: Campfire Spark, Chocolicious Bliss, Graham Glam, and Marshmallow Glow. Balmuccino asserts that Starbucks did not compensate it for the sale of these Sip Kits and is seeking unspecified compensatory and punitive damages. The company argues that its lawsuit is timely because New York law allows certain plaintiffs to suspend statutes of limitation when they file in the wrong jurisdiction, and a court determines it lacks authority. Balmuccino initially sued Starbucks in Los Angeles in October 2019. The case is Balmuccino LLC v. Starbucks Corp, US District Court, Southern District of New York, No. 24-06214.
